Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Kin website, mobile application, and related services (collectively, the "Service") offered by Antonin Baudelot ("Kin," "we," "us," or "our").

By creating an account, downloading the app, accessing the website, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission of a parent or legal guardian and only to the extent permitted by applicable law.

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

2. The Service

Kin is a private relationship app that allows users to share mood check-ins and related content with selected connections.

Kin is not:

  • a medical device;
  • a healthcare provider;
  • a mental health treatment service;
  • a crisis response service; or
  • a substitute for professional advice, diagnosis, treatment, or emergency assistance.

If you believe you or someone else may be in immediate danger, call 911. If you are in the United States and need mental health crisis support, call or text 988.

3. Your Account

You are responsible for:

  • providing accurate account information;
  • keeping your login credentials and device access secure;
  • all activity that occurs under your account; and
  • notifying us promptly if you believe your account has been compromised.

You may not impersonate another person or create an account for someone else without authorization.

4. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you acknowledge that we may process your information as described in the Privacy Policy.

5. Your Content and Permissions

You may submit content to the Service, including profile information, mood check-ins, optional photos, and other information you choose to share ("User Content").

You retain ownership of your User Content. You grant Kin a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and transmit your User Content solely as necessary to operate, improve, secure, and provide the Service to you and the connections you choose.

You represent and warrant that:

  • you own or control the rights necessary to submit your User Content;
  • your User Content does not violate any law or third-party rights; and
  • your User Content is accurate to the extent you present it as factual.

You understand that content you share through the Service may be visible to the connections you choose.

6. Acceptable Use

You may not use the Service to:

  • violate any law or regulation;
  • harass, threaten, stalk, or abuse any person;
  • post unlawful, defamatory, fraudulent, or infringing content;
  • attempt to access another user's account or private data without permission;
  • interfere with the security or operation of the Service;
  • reverse engineer, scrape, or exploit the Service except as allowed by law;
  • upload malware or malicious code; or
  • use the Service for commercial spam, surveillance, or unauthorized profiling.

We may remove content or restrict access if we believe conduct violates these Terms, creates risk, or harms users, us, or third parties.

7. Connections and Shared Content

Kin is designed for private sharing with selected people. You are responsible for choosing who you connect with and for understanding that anything you share with your circle may be seen, saved, described, or discussed by those recipients.

We cannot guarantee how other users will behave once they receive content you choose to share with them.

8. Paid Features and Subscriptions

Some features may require a paid subscription, including Kin+.

If you purchase a subscription through Apple:

  • billing, renewal, and cancellation are handled by Apple;
  • your subscription may renew automatically unless canceled in your Apple account settings;
  • pricing and taxes will be shown before purchase; and
  • refunds are subject to Apple's applicable policies.

We may change pricing, features, or subscription offerings to the extent permitted by applicable law. Any price change will apply prospectively, not retroactively.

9. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, including features, design, integrations, or availability, with or without notice where permitted by law.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.

10. Intellectual Property

The Service, including its software, design, trademarks, logos, text, graphics, and other content provided by Kin, is owned by or licensed to Kin and is protected by intellectual property and other laws.

Except for the limited right to use the Service under these Terms, no rights are granted to you.

11. Feedback

If you provide suggestions, ideas, or feedback, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback without restriction or compensation to you.

12. Termination

You may stop using the Service at any time and may request account deletion through the app or by contacting us.

We may suspend or terminate your access if:

  • you violate these Terms;
  • we reasonably believe your use creates legal, security, or reputational risk;
  • we are required to do so by law; or
  • continued operation of your account is no longer commercially feasible.

Sections that by their nature should survive termination will survive, including sections relating to ownership, disclaimers, limitations of liability, indemnity, and dispute terms.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR THAT THE SERVICE WILL BE SECURE OR ERROR-FREE.

WE DO NOT WARRANT THAT MOOD CHECK-INS, SUMMARIES, PATTERNS, OR OTHER OUTPUTS ARE MEDICAL, CLINICAL, OR OTHERWISE SUITABLE FOR HEALTH OR SAFETY DECISIONS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF KIN FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: THE AMOUNT YOU PAID TO KIN FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR $100 USD.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Kin and its affiliates, officers, directors, employees, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your User Content;
  • your misuse of the Service;
  • your violation of these Terms; or
  • your violation of any law or third-party rights.

16. Third-Party Services

The Service may rely on or link to third-party services, including Apple, hosting providers, authentication services, analytics providers, or infrastructure vendors. We are not responsible for third-party services or their terms, policies, or actions.

17. Apple-Specific Notice

If you access the app through an Apple device or the Apple App Store, you acknowledge that:

  • these Terms are between you and Kin, not Apple;
  • Apple is not responsible for the Service or its content;
  • Apple has no obligation to furnish maintenance or support services for the Service;
  • to the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the Service;
  • Apple is not responsible for addressing claims relating to the Service, including product liability, legal compliance, or consumer protection claims; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles, except to the extent superseded by applicable U.S. federal law.

Unless applicable law requires otherwise, any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you and Kin consent to personal jurisdiction and venue there.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms, update the "Last updated" date, and provide any additional notice required by law.

Your continued use of the Service after the effective date of updated Terms means you accept the updated Terms.
